1. Area of Application

The general terms and conditions set out herein are restricted to persons taking part in the Regata copa del Rey Sailing Regatta in any of its forms. Via registration in the competition (via any method and, especially, the form provided for this purpose on this website), You declare to be in agreement with the applicable law and the present terms and conditions.

Registration shall imply express user consent for transfer of their personal data contained in the referenced file sent to the sales channel collaborating with the REAL CLUB NAUTICO DE PALMA in commercialising their Services, as well as those persons or institutions whose intervention is necessary for the provision of their Services by the REAL CLUB NAUTICO DE PALMA to the user or to answer to applications for products or services made by the user via the Internet Services provided by the REAL CLUB NAUTICO DE PALMA. The purpose of said transfer may only be the fulfilment of information, training and commercialisation work by the assignees in relation to the referenced products and services requested by users.

2. Applicable Law and Jurisdiction.

General Use Conditions and the other legal conditions of the website are governed in each and every point by Spanish law.

Any action arising from or related to the present contract shall be exclusive competence of the courts in Palma de Mallorca, Spain with the REAL CLUB NAUTICO DE PALMA reserving the right to sue in your place of residence or registered office.

3. Object of the purchase.

In any of the selected payment methods (bank transfer / credit card), users are purchasing their pre-registration and corresponding right to take part in the 2007 edition of the Regata Copa del Rey sporting competition planned to take place between the 18th and 22nd April 2007 (both inclusive).

4. User obligations in sporting and maritime matters.

Acceptance to be subject to the ISAF Sailing Regatta Regulations (RRV), the RFEV Pre-Registration, Class Rules, Regatta Announcement, Regatta Instructions, as well as admitting the penalties possibly handed to them and other actions possibly taken under said Rules contingent upon appeals and revisions, refusing to take any of them before any Court or Tribunal.

Recognition, as set out in Fundamental Rule 4 in Part 1 of the ISAF Sailing Regatta Regulations, of being solely responsible for deciding if entry is taken or not or if they continue in the trial and accepting not to submit any issue relating to said decision and its consequences to any court or tribunal.

Recognition of being aware of Service Instruction 2/1999 from the General Merchant Navy Office Chapter 2 Point 7 which states literally: ‘Warn participants, before the start of the trials, that boats may only take part if they are duly dispatched for sailing in the seas where the trial takes place and if the owners have the sufficient certification for navigation.’

4. Cancellation and reimbursement right

The participant may cancel their participation in any irrefutable written communication in a period of seven (7) working days from the reservation allocation date.

The REAL CLUB NAUTICO DE PALMA shall return paid sums to the participant, with a deduction for costs said cancellation may cause, with a fixed 10% minimum of the amount paid for reservation. Fees the financial institution may have charged the user shall also wholly be down to the latter and shall not be returned. The failure to put the cancellation in writing, as well as a cancellation carried out after the set period has passed, shall imply full user consent, with all refund rights being lost. If, in spite of this, the user unduly demands cancellation of the corresponding charge on their credit card, the former shall be obliged to compensate the REAL CLUB NAUTICO DE PALMA for damages due to said cancellation.

5. Changes to the terms and conditions

The REAL CLUB NAUTICO PALMA reserves the right to change these general business terms and conditions. You are obliged to regularly check updates to these terms and conditions on the REAL CLUB NAUTICO PALMA webpages.

The REAL CLUB NAUTICO PALMA shall inform of any changes on the effective date via the ‘Terms and Conditions’ link at the bottom of the www.regatacopadelrey.com webpage.

In accordance with what is set out in the Personal Data Protection Act 15/99, dated 13th December, it is hereby stated that the information registered in this form is solely for managing regatta registrations and shall be kept in an IT file controlled by the Real Club Náutico Palma. Those persons to whom the data pertains may exercise their right of access, rectification, opposition or cancellation by addressing their request to the Regatta Office at the Real Club Náutico Palma. The REAL CLUB NAUTICO PALMA wholly complies with current legislation relating to personal data protection and confidentiality commitments inherent to its business.

Information and use right
